Mortgage Contingency

Mike Starr·Reviewed August 2026

A mortgage contingency (also called a financing contingency) is a clause in a real estate purchase contract that makes the sale conditional on the buyer obtaining financing. If the buyer cannot secure a mortgage within the specified timeframe, the contingency allows them to back out of the deal and recover their earnest money deposit without penalty.
